Webmail subscription: Terms of Service

 

Description

The Webmail subscription allows you to access certain email platforms using a proprietary method (e.g. not a standard protocol like POP3 or IMAP).

 

Payments

Payments are processed by FastSpring.com.  Payments will be renewed automatically, but can be changed to manual renewal within your FastSpring account management.

 

Accessibility

Access to Webmail services rely on a consistent interface provided by the Webmail provider.  Any changes made by the provider may prevent POP Peeper from accessing your Webmail account and require an update to the Webmail plugin.  When a Webmail service is interrupted, providing an update will be given immediate priority; however, there is no guarantee when or if the fix will be available.  In some cases, your subscription may be extended for compensation.

 

Usage

The Webmail subscription may be installed and activated on up to three devices; however, it may only be in use on ONE device at a time.  If you need to access Webmail services from multiple devices simultaneously, you need a separate subscription for each device.

 

Privacy

POP Peeper connects directly to the email service (including Webmail) and your email does not pass through Esumsoft servers.  Statistical information (such as the type and number of webmail accounts you're using) may be sent to Esumsoft to determine the viability of maintaining the services, but will not be shared with any other parties.

 

Cancellation

You may cancel your subscription through your FastSpring account.  Your subscription will remain active until the end of your remaining subscription period.

EXCEPT AS EXPRESSLY PROVIDED FOR HEREIN, THE SERVICES AND ALL RELATED COMPONENTS AND INFORMATION ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT ANY WARRANTIES OF ANY KIND, AND WE EXPRESSLY DISCLAIM ANY AND ALL WARRANTIES, WHETHER EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, TITLE, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. CUSTOMER ACKNOWLEDGES THAT WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

Limitation of Liability

NEITHER PARTY (NOR ITS SUPPLIERS) SHALL BE LIABLE FOR ANY LOSS OF USE, LOST OR INACCURATE DATA, FAILURE OF SECURITY MECHANISMS, INTERRUPTION OF BUSINESS, COSTS OF DELAY OR ANY INDIRECT, SPECIAL, INCIDENTAL, RELIANCE OR CONSEQUENTIAL DAMAGES OF ANY KIND (INCLUDING LOST PROFITS), REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY OR OTHERWISE, EVEN IF INFORMED OF THE POSSIBILITY OF SUCH DAMAGES IN ADVANCE. NEITHER PARTY’S AGGREGATE LIABILITY TO THE OTHER SHALL EXCEED THE AMOUNT ACTUALLY PAID BY YOU TO US FOR PRODUCTS AND SUPPORT AND MAINTENANCE IN THE 12 MONTHS IMMEDIATELY PRECEDING THE CLAIM.
